Collections Seminar
This seminar covers all of the key legal issues that impact delinquent vehicle loans, repossessions, and the disposition of collateral. Credit union collectors and collection departments must have a thorough and correct understanding of what to do, what not to do, and how to do it. Participants will gain a clear understanding of the legal duties and obligations that must be met in this critical operational area. In addition, guidelines, procedures and policies that must be in place to avoid liability will be covered. More consumer lawyers are focusing on this area of credit union collection activity than any other. It is critical that credit union collectors know the law and comply in order to avoid potential liability for their credit union as a result of wrongful repossession.
Collectors of all experience levels will benefit from this practical look at the legal issues surrounding credit union repossessions.
Bankruptcy Seminar
The economy has wreaked havoc on the job market and, with the 2005 bankruptcy reforms now in the distant past, bankruptcies are spiking art an alarming rate. This session focuses on bankruptcy essentials for the new credit union bankruptcy officer, but more importantly will emphasize current and emerging problems for the credit union in the bankruptcy courts. These problems are costing credit unions millions across the country. They include: automatic stay issues involving post-petition repossessions, payroll deductions, credit reporting, and other unintentional violations. The failure to properly perfect liens on automobiles is resulting in dire lien avoidance problems. Bankruptcy fraud continues to go unchecked. Reaffirmation Agreements have taken a new turn in 2010. And seemingly harmless areas, like proofs of claims, are now exposing credit unions to serious liability. All these issues will be addressed, along with many more.

Registrant Cancellation Policy
Substitutions are always welcome. Registration fee refunds (less a $50 processing fee per person/per seminar) are granted for cancellations received in writing two weeks prior to the seminar. Locations with less than 20 registrants four weeks out may be cancelled. In event of cancellation, all registrants will be notified.

Presenters
Mike Blalack is a founding shareholder and principal of Blalack & Williams. Since 1975, Mike has focused exclusively on the representation of state and federal credit unions with a particular concentration in the areas of lending and deposit account system development, consumer credit and collections issues and collections litigation. Mr. Blalack was instrumental in the development of many of the earliest open-end credit products in the industry, and he is an acknowledged authority on the truth-in-lending and truth-in-savings issues, secured transactions and bank deposits and collections. He has conducted hundreds of seminars and is a frequent lecturer across the country for state credit union leagues, trade associations, credit union chapters and individual financial institutions. He is a member of the Dallas Bar Association and the Consumer Law section of the State Bar of Texas. He provides frequent counsel to financial institutions on matters affecting directors' and officers' duties and responsibilities.
Charles Williams is a founding shareholder and principal of Blalack & Williams. For nearly three decades Mr. Williams has concentrated his practice on the representation of credit unions and financial service providers, specializing in state and federal regulatory affairs, lending and deposit account systems and policy development, bankruptcy representation and consumer credit issues. He is a member of the Dallas Bar Association, the Corporate, Business and Bankruptcy Law section of the State Bar of Texas, and the Texas Association of Bank Counsel. He is a member of the Business Law section of the American Bar Association and serves on the credit union operations subcommittee. Mr. Williams is a frequent instructor and lecturer around the country for state credit union leagues, trade associations, credit union chapters and individual financial institutions addressing bankruptcy issues, deposit and lending compliance topics and other operational, managerial and regulatory issues. He serves as an adviser to numerous businesses serving financial institutions in the development of lending and deposit account forms, and he advises his credit union clients in the formulation and maintenance of contractual relationships with their vendors and service providers.
