2010 Home Equity Lending Seminars

As many of you may have read, the Federal Reserve Board has indicated that it expects an announcement during May on new closed-end real estate lending rules. Blalack & Williams advises that these rules may have major impact on Home Equity lending in Texas, and plans to cover any such rules during the 2010 Home Equity seminars. Accordingly, the Dallas seminar will be rescheduled for Wednesday, November 3, 2010 and Thursday, November 4, 2010 so that any new Federal Reserve forms and disclosures can be thoroughly reviewed before the Dallas and Houston seminars. If for some reason these new rules are not final, or will not be effective in the near future for any other reason, we will still present all Home Equity seminars at both the Dallas and Houston locations during the Fall.

Day One: Basic/Intermediate Home Equity Lending Seminar
This seminar is primarily for Texas state and federal credit unions that are in the early stages of a traditional Texas Home Equity lending program, but also provides a refresher for those credit unions that have made Texas Home Equity loans for some time.

The seminar includes rules for permissible lending against member homestead under the Texas Constitution and statutes, a step-by-step analysis of the extensive Texas Constitutional Amendment containing the legal requirements for a Texas Home Equity loan, new rules for curing errors in existing Home Equity loans, current status of the ACORN lawsuit, loan policy and procedure rules, guidelines, and suggestions for Texas Home Equity lending established by NCUA and the Texas Credit Union Department.

The seminar is also structured to allow the speaker a maximum amount of time for discussion of individual questions and concerns.Please note that this seminar will not address HELOCs.

Day Two: Advanced Home Equity Lending Seminar
This seminar focuses on very recent and important developments in the Texas Home Equity lending area. It covers the latest guidance and completion requirements for the new Good Faith Estimate and HUD-1A forms, including line item explanations and a discussion of HUD's latest version of the "Frequently Asked Questions" concerning these new forms.

Additional critical topics are the new required changes to the Regulation Z Federal Box Disclosure, possible application of new Regulation Z Section 35 "Higher-Priced Mortgage Loans" and Section 32 "HOEPA" rules to Texas Home Equity Lending, requirements of the Secure and Fair Enforcement for Mortgage Licensing Act (S.A.F.E. Act), and an extensive discussion of permissible modifications to Texas Home Equity loans to alleviate member distress."

Presenters

Thomas H. Duke
Tom Duke has practiced law with Blalack & Williams since 1996 and has over two decades of experience in the financial services industry. After commencing his legal career as a litigation attorney in the banking section of a Dallas law firm, Tom went on to become Assistant General Counsel and Compliance Officer of a major Texas bank holding company. During the banking crisis of the early 1990s, Tom was employed by the FDIC to document the foreclosure and sale of numerous and sizeable commercial and residential real estate properties. During his tenure at Blalack & Williams, Tom has assisted the firm's clients with diverse real estate projects, foreclosure on mortgage loans and Home Equity loans and the development of documents for consumer investment and rental property loans. Tom has developed significant expertise in the Home Equity lending area, and answers credit union questions on a daily basis relating to Home Equity, Mortgage, and Home Improvement lending. Tom provides extensive training for credit unions in all areas of Home Equity lending and is a frequent speaker at Home Equity seminars throughout the state of Texas. Tom also assists the firm's clients in their review of all types of vendor contracts and loan agreements.

Jared Ihrig
Jared Ihrig joined Blalack & Williams in 2009. Prior to joining the firm, Jared served both as Senior Compliance Officer as well as Director of Compliance and Assistant General Counsel for two of the largest federal credit unions in the United States. Jared has also served as a partner in a regional law firm specializing in mortgage banking regulatory compliance matters, representing many prominent national lenders in the areas of document preparation and single family residential property regulatory compliance at both the state and federal levels. Throughout his career, he has been responsible for handling state and federal examination issues involving numerous regulatory matters and concerns facing credit unions. Additionally, Jared has counseled and advised management and credit union boards of directors in many areas of regulatory and operational compliance, has conducted contract reviews and negotiations, implemented new regulatory policies and procedures, and provided credit union staff with regulatory interpretations and legal opinions involving a myriad of credit union business functions.
